Welcome to Winter Technologies (“we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your purchase and use of digital products (e.g., Roblox assets, plugins, models, game packs, scripts, etc.) from our websites wintertech.xyz and clearlydev.com (“Sites”).
By placing an order through our Sites, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not purchase or use our products.
1. Definitions
“Products” means any digital items, files, assets, scripts, models or other digital content made available for purchase on our Sites.
“User”, “you”, “your” refers to the individual or business purchasing or using the Products.
2. Purchase & Payment
2.1 You agree to provide accurate and complete information when placing an order.
2.2 All payments are processed securely through third‑party payment providers. We do not store your payment card details.
2.3 Prices displayed on the Sites are in your selected currency and may include VAT or other taxes as required by law.
3. Delivery
3.1 Products are delivered digitally. After successful payment, you will receive a download link or access to your product in accordance with the product type.
3.2 Delivery may be subject to limitations of your device, platform (e.g., Roblox Studio), or internet access.
4. License & Use
4.1 When you purchase a Product, Winter Technologies grants you a non‑exclusive, non‑transferable, revocable license to use the Product under these Terms.
4.2 You may use the Product in your personal or commercial Roblox projects unless the product description explicitly states otherwise.
4.3 You may not:
- Redistribute, resell, sublicense or share the Product with any third party.
- Claim ownership of the Product or represent it as your own.
- Modify, decompile, or reverse engineer any Product beyond what is permitted by Roblox terms.
5. Refunds & Cancellations
5.1 All sales are final due to the digital nature of our Products.
5.2 We may offer refunds or exchanges at our discretion, particularly if a product is faulty or not as described.
5.3 Requests for refunds must be submitted within 14 days of purchase via our contact email.
6. Support
6.1 We offer support for purchased Products through our designated support channels (e.g. email, Discord, support page).
6.2 Support does not include custom development unless explicitly purchased or agreed upon.
7. Intellectual Property
7.1 All Products, content, designs, images, logos, code and materials on the Sites are owned or licensed by Winter Technologies and protected by copyright and other intellectual property laws.
7.2 You do not gain any ownership rights in the Product beyond the limited license granted in Section 4.
8. Warranties & Disclaimers
8.1 Products are provided “as is,” and Winter Technologies makes no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non‑infringement.
8.2 We do not guarantee that Products will work with all systems, platforms, or future updates of Roblox.
9. Limitation of Liability
9.1 To the maximum extent permitted by law, Winter Technologies and its affiliates are not liable for indirect, incidental, special, or consequential damages arising out of or in connection with your use of Our Products.
9.2 Our total liability for claims related to a purchase shall not exceed the amount you paid for the relevant Product.
10. Governing Law
These Terms and your use of the Products are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of courts in that jurisdiction.
11. Changes to Terms
We may update these Terms from time to time. The “Last Updated” date at the top will reflect the effective date of changes. Continued use of our Products after updates constitutes acceptance of the new Terms.
